The order was passed after the deceased’s sister filed an application before the court to look into the matter.Advocate Tanveer Nizaam, who is appearing on behalf of the deceased’s sister, Sudesh Kataria, said that since the accused were police officials, there could be some alleged loop holes in the police inquiry and also in the special investigating team (SIT), which was set up to investigate the matter. The SIT was meant to protect the top cops involved. The reason why the application requested the court to look into the matter.”The five accused have been arrested including Ghadoli’s girl friend Divya Pahuja. Another is yet to be arrested, but is absconding. However Amit Kumar, a Senior police officer who we believe was the head of the encounter team was not named in the FIR. The police claim that Kumar was not present in the Andheri-based hotel room, where Ghadoli was allegedly shot by the police. Kumar was outside the room, according to the police,” said advocate Nizaam.After the court passed an order in the application seeking magistrate inquiry Nizaam said, “After months of legal proceedings the family of Sandeep Ghadoli has finally been given much needed respite under section 176(1-a)CrPc, when the operative order was finally passed on Friday. Further inquiry under section 176(1-A) of CrPC PC has to be conducted by this court.”Nizaam further said that the family thanked the court for diligently hearing them and were grateful that the matter will be further investigated and the guilty brought to book under section 120(B) IPC. The family has filed an application against the SIT for proper investigations and monitoring of the investigation by the Metropolitan magistrate court under 156(3)CRPC.”Sandeep Ghadoli (36) was killed by a police team from Gurgaon in Hotel Airport Metro at Marol on February 7, 2016 around 11.20am. His brother Kuldeep Singh had filed a petition in HC seeking FIR against the police team as well as a judicial inquiry on the entire episode.
