Justice Thakur was anguished when some of the lawyers raised their voice to interrupt the submission of Attorney General Mukul Rohatgi, who was arguing for the government, and senior advocates like Kapil Sibal and P Chidambaram. “This is not a way to argue. You people are making it a fish market. You people don’t want senior advocates like Sibal to speak. See Mr Chidambaram has not yet stood up. This is very unfortunate. In 23 years of me as a judge, I have not seen such behaviour. This is the last week as a judge and I would be going with a heavy heart. What kind of decorum is maintained? This is CJI’s court and yet no decorum. You can’t be allowed this kind of behaviour,” the CJI, who will be demitting office on January 3, said.

Considering his responsibilities and duties and in interest of justice, permanent exemption from personal appearance before a trial court is granted to the petitioner,” the court said.It also clarified that the counsel duly nominated by the Chief Minister shall also not seek adjournment on any ground in the matter before a trial court. The court said that if on any specific date the trial court needs the presence of Kejriwal, it can direct him to appear before it and the chief minister “will have to comply”.The court’s order came on Kejriwal’s plea seeking permanent exemption from personal appearance before a trial court in the defamation case filed against him by Amit Sibal.Senior advocate Sudhir Nandrajog, appearing for Kejriwal, submitted that it was not possible for his client to appear on each and every date before a trial court as he, being the Chief Minister of Delhi, had many other things to look after.”Notice has been framed in the matter. Cross examination is going on,” the counsel said and asked why his client was required on each and every date.

New Delhi: The BJP-AAP war of words on cross-LOC surgical strikes on Thursday intensified as the Arvind Kejriwal-led party accused Defence Minister Manohar Parrikar of “demeaning” the armed forces and threatened to file a police complaint against him.

I have asked her four questions. She once said that had they knew that Burhan Wani was hiding, he could have been saved. They consider Afzal Guru as a freedom fighter. If she does not answer, the BJP must answer as to why such people are coming to power who don’t love the nation and aren’t ready to recognise terrorists as terrorists,’ Mishra told the reporters.‘We are electing such people who are not even ready to say ‘Bharat Mata Ki Jai.’I do not want to share any stage with her. Sharing stage with her is an insult. I am not questioning Mehbooba Mufti’s election; I am questioning her stand on this sensitive issue,’ he added. Speaking at the launch function of the Bharat International Travel Bazaar (BITB), Mishra earlier had said, “It does not work this way that we will not call Burhan Wani a terrorist but tourism will have to flourish in India. How will that happen’ You will say Afzal Guru is not a terrorist and that he should not be hanged. How will tourism develop’ It is not going to happen.”Earlier, the Delhi Minister asked Mehbooba “if she considered Burhan Wani a terrorist.’ ‘It can’t be that you don’t accept Burhan Wani as a terrorist and then expect tourism to increase. Terrorism and tourism can’t go together. Mahesh Sharma said Kashmir is our pride, but terrorists are treated as tourists there,’ said Mishra.‘We can fight Pakistan, but how do we fight with people who give shelter to terrorists in Jammu and Kashmir,’ he added. The AAP leader underlined that it is “painful” to see that “terrorists are being treated as tourists in Kashmir.”After Aam Aadmi Party (AAP) leader and Delhi Tourism Minister Kapil Sharma taunted Mehbooba Mufti for not accepting Hizbul Mujahideen commander Burhan Wani as a terrorist; the Jammu and Kashmir Chief Minister retorted that women are the safest in Kashmir. Speaking at the launch function of the Bharat International Travel Bazaar (BITB), Mehbooba said, ‘Any place in the world, including Delhi, women are safest in my Kashmir. They move around in shikaras and houseboats. That’s the biggest thing my state can offer. As compared to any place in the world, including Delhi, women and girls are safest; there is no fear of getting raped in a car.’She also said that the biggest confidence building measure would be if a visit is paid to Jammu and Kashmir.‘The biggest confidence building measure is if you visit our state, it shows that you trust us. We need you, I don’t know if you need Kashmir or not, but Kashmir needs you,’ Mehbooba said.‘People of our nation are so nice and so are the people of Jammu and Kashmir,’ she added.

Ahmedabad: Rejecting the theory of a conspiracy behind the Gulbarg Society massacre here during the 2002 Gujarat riots, the special SIT court on said there was no evidence to support it.
“There was absolutely no pre-planned conspiracy to butcher or kill members of the minority community, more particularly at Gulbarg society,” special judge PB Desai said in the order.
“The evidence…with regard to the elements of criminal conspiracy is extremely flimsy,” it said.
The court sentenced 11 convicts to life imprisonment in the case related to the massacre where 69 people, including former Congress MP Ehsan Jafri, were burnt alive on 28 February, 2002.
The court awarded a 10-year jail term to one accused while 12 others were given a seven-year sentence.
Testimony of one of the witnesses that Kapil Munna, an accused, told him that he was going to attend a meeting where the murder of Muslims would be planned was “uninspiring and downright ridiculous,” the judge said.
According to this witness, Munna told him this between 9 and 10 a.m on 28 February, while other witnesses had said the violence had begun at around 9 a.m itself, the court noted.
The prosecution had also referred to a visit by the senior police officers including the then police commissioner P C Pandey and joint commissioner of police M K Tandon to the Gulbarg Society before the incident to assure the residents that there would be proper police security.
The police officers stayed away when the carnage began, which supported the theory of criminal conspiracy involving high- ranking government officials, political leaders and police, said the prosecution.

New Delhi: Congress will move court if the Centre issues ordinance to authorise expenditure beyond 1 April in Uttarakhand which is under President’s rule, party leader Kapil Sibal said on Thursday.
“Promulgation of any such ordinance would be unprecedented and unconstitutional,” Sibal, a senior Supreme Court lawyer, told reporters here.
He attacked the Centre accusing it of being “not concerned about parliamentary democracy and the Constitution”.
Taking a dig at Finance Minister Arun Jaitley, also a senior advocate, Sibal remarked, “I must congratulate Jaitley.
It is a first to his credit. The central government will decide whether Budget in an Assembly is passed or not.”
Claiming that the Budget has already been approved by the Uttarakhand Assembly, he said that the Speaker has declared so and there has been no petition in any court against it nor has anyone approached any court.
Targeting BJP and the Centre, he alleged that they wanted to show anyhow that the Budget has not been passed on the floor of the Uttarakhand Assembly.
He accused the Centre of playing this “political game” as part of its attempts to destabilise the state government.
“They swear by the Constitution, but tearing it to shreds,” he said.
He said that the prorogation of Budget session of Parliament for enabling the government to issue such an ordinance was also part of this game.
“They are afraid that if they bring the bill in Parliament on the matter, they will be defeated,” he said.
Congress has accused the Centre of having “murdered democracy” by imposing President’s rule in Uttarakhand.

Stating that the national capital has never faced a water crisis of such magnitude, Delhi Water Minister Kapil Mishra said on Sunday that poison was being dumped into the water supply in certain parts in Haryana, resulting in the high ammonia level which had forced the shutdown of two major water plants.”For the past two months, we have been forced to shut down the water plant several times due to the ammonia content. The plants at Wazirabad, Chandrawal and Okhla have been shut down. The main canal which supplies water has been damaged due to the Jat agitations. Delhi has never faced such a water crisis before,” Mishra said.<!– /11440465/Dna_Article_Middle_300x250_BTF –>He asserted that despite the efforts by the state government, the ammonia level in the water kept rising which forced the shutdown of Wazairabad and Chandrawal plants.Mishra stated that he has been receiving evidences, reports and surveys on where the ammonia is being found. “Based on the reports that I got, it can be seen that poisonous water is being dumped into the waters in Haryana in some places. This is a clear violation of the Supreme Court order and its irresponsible behaviour, as we have been forced to shut down plants because of this,” he said.He also said that the current condition meant that water was not being able to reach almost 35-40 lakh people into the national capital and added that water will not be completely provided in north and central Delhi until Chandrawal and Wazirabad plants are activated again. “The ammonia level has reached 3.6 and our team is working 24 hours to fix the problem. The matter is simple… if there is poison in the water, we can’t supply it out,” Mishra said.During the quota stir, members of the Jat community had damaged the Munak Canal which is the main source of water for the national capital.
