Carter meets Parrikar, US to accord ‘Major Defence Partner’ status to India

The designation as a Major Defence Partner is a status unique to India and institutionalises the progress made to facilitate defence trade and technology sharing with India to a level at par with that of the US’s closest allies and partners, and ensures enduring cooperation in the future,” a joint statement after the meeting said. Carter also called on Prime Minister Narendra Modi.Officials explained that details regarding US licensing rules among other have been finalised. The statement added that both sides exchanged views on regional security issues including threat posed by terrorism.”They agreed to continue further strengthening the bilateral counter terrorism cooperation and underlined the need to ensure that terror groups receive no patronage from any State,” it said.Citing common values and shared desire for peace and prosperity in Asia Pacific and Indian Ocean Region, the two leaders reflected on the convergence of interests that have driven the strategic and technological “handshakes” between both nations and led to historic progress in bilateral ties, the statement added.It said that bilateral defence ties have in the recent years moved along a “remarkable upward trajectory”. “Thank you my friend,” Carter told Parrikar as both met at the South Block here. Carter said that this is the seventh meeting that he was having with Parrikar. “He is the Defence Minister with whom I have met for the maximum number of times,” he said emphasising the importance that US puts on its ties with India.During the meeting, which was more of a thanksgiving one, Carter said, “Today our defence relationship takes a major step as we designate India as a major defence partner. It now needs to be formally passed by the two chambers of the Congress — the House of Representatives and Senate — before US President Barack Obama can sign it into law. Marked progress on agreements, including the signing of a Defence Framework Agreement in 2015, have laid a blueprint for collaboration between our defence establishments and enabled deeper cooperation, the statement said.Parrikar and Carter applauded the deepened scope of India-US military-to-military ties, which includes a dramatic increase in defence trade. With regard to technology, both sides welcomed the tremendous progress achieved under the Defense Technology and Trade Initiative (DTTI) and committed to explore new proposals and other innovative opportunities for co-production and co-development. The emergence of DTTI as an integral and enduring component of India-US security cooperation is a sign that the relationship has matured to a level of strategic importance, the statement said.DTTI will strengthen India’s ‘Make in India’ initiative and both sides committed to convening all new DTTI working groups prior to the next DTTI Group meeting anticipated for February, 2017. Parrikar and Carter agreed that the strong partnership between our countries is lasting and will thrive and grow for decades to come. Meanwhile, Parrikar said he appreciated Carter’s strong commitment to defence partnership.”It is not an exaggeration that our defence relations are a major driver in our bilateral relations,” he said adding Carter’s conceptualisation of DTTI shows his interest in bilateral defence cooperation. Parrikar said he was happy to see conclusion of discussion on major defence partnership. “During our meeting over the last few years, we have agreed on practical exchanges such as LMEOA,” the Defence Minister said.He added, “I am confident that the defence cooperation will expand on the foundation you have built”. FDI reform: Why single brand retail may not see a single dollar of fresh money

The devil has always been in the detail. And it was no different in the case of liberal FDI norms, which the government announced with much fanfare across nine sectors last week.

A government press release promised the moon that Monday afternoon but now, when the changes have been notified, the picture does not seem quite as rosy. The notified changes fall short of what was actually promised.

For India’s airlines, initial euphoria over 100% foreign investment permission has been tempered by the revelation that such airlines may not be able to fly overseas at all. Basically, the reforms at least for airline ownership have been merely on paper. Now, it seems the single brand retail reform is also being panned as experts question several clauses in the explanatory Press Note 5, which notified the new FDI regime over the weekend.

The changes notified by the govt fall short of what was promised

For one, though the government seems confident of its meaning, the industry has largely been left confused over what exactly is meant by “state of the art / cutting edge technology” companies.

“There is no definition of state-of-the-art/cutting edge technology. These terms anyway cannot be defined, leaving any such proposals for investment from foreign players subject to different interpretations,” says Arvind Singhal of Technopak.

This means opening up single brand retail store by Apple, for example, may not happen despite the new FDI norms. Lack of clarity on simple terms which are crucial to avail relaxed sourcing norms, could be the undoing of this policy.

Kartick Maheshwari, Partner at Khaitan & Co, points out that the press release which was issued by the government on June 20 and the Press Note which notified these changes later give out different interpretations.

“There is no 3-year blanket waiver from local sourcing norms (as promised in Monday’s press release). The sourcing exemption for single brand retailers whose product line-up is ‘state of the art / cutting edge technology’ and where local sourcing is not possible has been reflected as 3 years (not 5 years as promised in the press release). As such, the press note undoes the significant relaxations announced for this sector by the Union Government.”

He says the implementation of the initial announcement needs to be revisited or there will be little improvement in investments in the single brand retail sector. The confusion over whether the earlier, mandatory local sourcing for single brand retail firms has been relaxed for all, those which fall under the cutting-edge/state-of-the-art category only or none prevails. Doubts also remain over the extent of this exemption.

Not just definition of which brands fall under these relaxed norms, the interpretation of how relaxed the norms are also vary. Anil Talreja, Partner at Deloitte in India says a definition of what is state-of-the-art/cutting edge is there in the Press Note. He also interprets the note to mean that such companies will now be exempt from 30% local sourcing norms for three years after they set up their first store. And they can subsequently comply with this norm for the next five years by sticking to it through cumulative sourcing instead of complying with an annual sourcing amount.

“The government has recognised difficulties being faced by foreign investors due to sourcing requirements… This is not a big bang change though. The government will have to see the effects of these baby steps before making further changes,” he said.

A third point which has created confusion among the industry watchers is about total opening up of the food retail sector on which multiple restrictions on multi-brand retail also apply.

A BigBasket or any other food retailer also sells FMCG, other non-food products. To get FDI, what should such retailers do now?

“While 100% FDI is permitted in food products sector, most of the retailers trading food products also sell non-food household items; thus leading to challenges in implementation,” said Subrata Ray and Kinjal Shah of rating agency ICRA noted this in their report.

Non-food retail entails a host of conditions for FDI which include retailing only in one million-plus cities, mandatory investment size, 30% sourcing from micros and SMEs etc. To bypass these restrictions, will food retailers then separate their food and non-food businesses, set up separate arms and further complicate matters?

One industry expert pointed out that with these confused signals, not a single dollar of foreign investment may actually arrive in India’s single brand retail stores.

According to an analysis in the Business Standard, the sectors that saw liberalisation in FDI last week account for a small share of overall FDI inflows into India.

Trading (including retail) and pharmaceuticals together account for just 4% share of total overseas equity inflows in the last 16 years. With the complete dissonance between what the government promises and what it delivers, the share of retail trade in overall FDI inflow is unlikely to rise anytime soon.

India to get access to almost 99% of US defence technologies, says top American official

Washington: India will be the only country outside US’ formal treaty allies that will gain access to almost 99 percent of latest America’s defence technologies after being recognised as a ‘Major Defence Partner’, a senior Obama administration official has said.

“India (now) enjoys access to (defence) technologies that is on par with our treaty allies. That is a very unique status. India is the only other country that enjoys that status outside our formal treaty allies,” the official told PTI explaining what ‘Major Defence Partner’ status means for India.

Early this month, after a meeting between US President Barack Obama and Prime Minister Narendra Modi at the White House, the US, in a joint statement, recognised India as a ‘Major Defence Partner’.

“We were looking for something unique. This language you would not find in any arms transfer legislation or any of our existing policies. This is new guidance and new language that is intended to reflect the unique things that we have done with India under our defence partnership,” the senior administration official said.

“This is intended to solidify the India-specific forward leaning policies for approval that the (US) President and (Defense) Secretary (Ashton) Carter…and our export control system have implemented in the last eight years,” the official said.

Under this recognition India would receive license-free access to a wide range of dual-use technologies in conjunction with steps that New Delhi has committed to take to advance its export control objectives. Acknowledging that the impression in New Delhi is that India is not getting access to the kind of technology it needs from the US, the official said it is a constant source of discussion.

“(In reality), less than one per cent of all exports (requests) are denied (to India). They are not denied because of India. They are denied because of global US licensing policies. We do not share certain technologies with anybody in the world,” the official asserted.

The perception in India that the denial of such technologies is reflective of India-US relationship is far from the truth, the official said. According to the official, India being recognised as a “major defence partner puts it on par with our treaty allies”.

Inside the American bureaucratic system, such a recognition removes a number of major export control hurdles for India.

ITR Form: Experts call for more details on asset disclosure

New Delhi: People earning more than Rs 50 lakh will find it challenging to declare cost of inherited properties and gift items in the new Income Tax Return (ITR) Form for the Assessment Year 2016-17, say tax experts.

The new ITR, notified by the Central Board of Direct Taxes (CBDT) yesterday, requires people with high income to declare cost of land, building, jewellery, bullion, vehicles, yachts, boats and aircraft, in addition to cash in hand.

A new reporting column ‘Asset and Liability at the end of the year (Applicable in a case where total income exceeds Rs 50 lakh)’ has been introduced in the ITR.

While tax experts said the CBDT has done the right thing by notifying the ITR Form for Assessment Year 2016-17 in March itself, it has not yet come with the required instructions for determining the cost of immovable and movable assets.
Individuals are required to file their tax return for the previous financial year by July 31.

“Individuals are likely to face a challenge in determining cost for gifted assets (such as jewellery), inherited assets and for assets purchased several years earlier where records have not been retained,” said Tapati Ghose, Partner, Deloitte Haskins & Sells LLP.

A threshold limit for each category of asset for disclosure purposes would provide an administrative relief in case assets below a prescribed threshold are exempted from disclosure requirement, Ghosh said.

Amit Maheshwari, Partner, Ashok Maheshwary and Associates said last year there were lot of petitions as the tax department had notified the ITR closer to the last date of filing the returns.

“This time they have done the right thing by coming out with the new ITR at the beginning of the new financial year. I think people have enough time to file their returns,” he said.

Filing for the new forms begins with the onset of the new financial year today.

Global tax consultancy firm KPMG said that at this stage it appears that the disclosure required in the new ITR Form is to collate information and evaluate the income vis-à-vis the net wealth of an individual.

“We will have to wait as to how this data is utilised in the future i.e. whether any additional tax is levied on the personal wealth, especially when Wealth tax has been withdrawn in the recent past,” it said.

Experts also said new ITR Form will help in dealing with the menace of black money.

Finance Minister Arun Jaitley has already announced a scheme to enable black money holders to come clean by paying 30 per cent tax and 15 per cent penalty. For the purpose, government will provide a compliance window.

Last year he came out with similar scheme for flushing out black money stashed abroad.

PM Modi releases Jain monk’s 300th book via video-con

Event organiser Kalpesh Shah said he felt blessed to have received the original text of the book written by the monk before it was sent to print. “I shall always be indebted to him for this,” he said. Over 50,000 copies have been published and some of them were given to the dignitaries who visited on the last day of the event, including chief minister Devendra Fadnavis’ wife Amrita Fadnavis.

Chaiwala in Kanpur gets CBI summons in Vyapam scam

The MP STF has listed as many as 54 students of this medical college as accused in this scam. The accused students belong to batches from 2009 to 2014. Out of these, 22 students have re-joined the college, six are in jail and eight are missing from the college. The remaining 18 students were from 2009 batch about whom the college didn’t have any information.

Armyman misbehaves with woman on Rajdhani, held

Earlier on December 28, an army jawan forced a minor girl to consume alcohol while she was allegedly gang raped by two paramilitary force personnel inside a compartment, reserved for security personnel, of the Howrah-Amritsar Express. She was later rescued by RPF in Madhupur station in Jharkhand. The three accused were subsequently arrested and identified by the victim.

Investigators who are looking into the case are strongly suspecting that the first group comprising two terrorists had managed t enter the airbase around noon on January 1 itself and remained undetected for the entire day.
They are also looking into the possibility that the group of four terrorists may have also joined the first one much before the agencies could point out that they could be heading towards the airbase.”We are not ruling out a foul play and an insider’s job. Gurdaspur SP to be questioned by NIA on Jan 11

Commenting further on the ongoing investigation, agency officials said,”The post-mortem of the terrorists has been conducted and body tissues have been preserved for DNA sampling. DNA samples lifted from both the vehicles used by the terrorists are being sent for forensic examination and so are the footprints recovered from Bamiyal”. The second vehicle belonged to taxi driver Ikagar Singh,who was allegedly killed by the armed men before the attack. The agency are also probing his murder and possible connection to the attackers of the air base.
